Terms of Services of Vultr
I assume every person on the Net reads ToS/AUP/Privacy Policy of provider thery plan to use (no joke; I always do). Vultr (hereinafter "The Company") looks like a new player on cloud services market, and becoming more and more popular (good luck to them, of course).
Personally, after studying their ToS, I felt somewhat disturbed at certain points:
The Company reserves right to keep copies of your data after you stop using their services (see ToS, 3.5)
If you happen or plan to use URL that can be misspelling or contain elements too similar to The Company's trademarks, you agree you may be required to pay significant fee. If you contacted them (since in doubt about certain URL) and they didn't answer within 30 days, it means you may not use the URL (see ToS 5.4 through 5.11)
If you allow other users to create content on your site (by creating a forum, for example), you might be qualified as Service Provider and, among other obligations, shall inform The Company about all domains, web pages or IP addresses for which you are acting as Service Provider (see ToS, 12.9)
There are other contents of ToS/AUP/privacy policy of The Company that make me less than comfortable, but the ones above donate most to this.
Could someone, with proper qualification in understanding legal documents, comment on whether the above should really bother me if I abide by all applicable laws (I always do)?
Comments
That bit is particularly scary as a customer of vultr. Might need some clarification from @Dave
Probably for backups or something.
If I meet some strange tos/aup I go to the next provider in the line. I dont use vultr right now and i do read the terms most of the time (except when i reuse some company after some time, even though they might have changed), but that is really strange, the last provision seems like excerpt from some chinese law...
No 2 does not make sense, also, if you would plan to do that, you would not host it on vultr, therefore the provision would be moot since you do not have to agree to their tos/aup, besides, there are laws regarding this.
No 1 is pretty standard, many people do that.
Would that include the scanned copies of Cardholder data?? (If they still do it) PCI gonna love these guys (as well as NSA) lol
Good luck
To me, this sounds like "We might have backup tapes with your data in a warehouse somewhere, and if you cancel, we're not going to worry about figuring out where all of these backups might be and deleting them"
Have you asked them about your concerns? Contrary to popular belief, policies are not always put in place by evil masterminds, sometimes they have a purpose you may not have thought of.
dont you think, thats why hes asking here ?
You make a good point.
I might be missing something - looks I need to sign up at their site first to contact about my concerns.
if you are worried about data retention then just encrypt the whole hdd. simple.
With regards to
1 - The Company reserves right to keep copies of your data after you stop using their services (see ToS, 3.5)
This isn't malicious in anyway. It simply protects us from certain features/backups/etc that may not purge immediately with the termination of your account. ie. an nginx.conf you paste in our support system and its backed up for 6 months on our systems(as a part of our internal backups of the entire support system).
2 - This will be removed.
I see, thanks. Perhaps you could elaborate this part, to explain? Regardless whether I keep my data encrypted, it makes me uneasy if I can't control when data are purged.
Good.
Also, could you add something like "Contact us" page/form to your site?
At the moment, when I need to contact you (i.e., access Support link), I have to be already registered. It means that I should agree to ToS in order to discuss whether it's safe to agree to it.
Thanks for prompt response.
and the number 3 ?
That is standard practice in China, I suppose western companies are learning.
Interesting, but we are not in China. :P
Who cares, freespeech is dangerous everywhere, you may never know when the terrorists will use your forum to communicate. You do not wish to go to Guantanamo, or be "extraordinarily renditioned", would you? So better help the good guys keep tabs on you, you would do that anyway, dont need a ToS/AUP to be a good
christiancitizen and fightislam, democracychild porn, but this is how companies show how much they care for theamericanyour dreams. That gives possibility for another interesting thread (perhaps not here, since it's not directly related to Vultr).
Any forum may be a place of dubious communication, yet it won't look like one.
you guys make me cry =(
May I ask, when?
And what about 3)?
And what about ability to contact Vultr without signing up first? Please give at least a valid email for contact purposes.
Thanks.
