you can try transmission in linux box simply 128MB Ram & 5 GB Disk is enough. please correct if i'm wrong

Actually, it matters a whole lot. If you think that you'll get away with illegal torrenting because "it's like private use" you won't be going anywhere. The only torrenting that they'll allow is legal torrents that don't lead to DMCA issues later on. If you're going to start causing problems for them by running illegal torrents, they will just shutdown your service and soon enough we will see a thread on the forums complaining about bad service and being scammed and ripped off.

We made a Windows Server 2008 R2 SP2 Template (yes Template) for some users who just wanted to quickly re-install their machines to host ASP.NET applications [ dev environments. ] We had to enable disk compression, and after all updates; had only 114MB of free space from a 15360MiB disk.
Windows Server 2003 or Windows Advanced Server 2000 could fit on a 5GB disk though, with some tweaking. [ Or WIndows NT, or something even older... ]
You need to look for offshore hosts, in simple words buy from a company which is not USA based. There are lot of such providers in Netherlands for example.
Out side US VPS are offshore host ?
That depends on your location. What is offshore for me might not be for you.And remember you will have to use your own license with a Windows to get it for as cheap as you're looking to do so.
