Its impossible to enforce a "mining is banned policy" on dedicated servers.
If the provider would say, its banned, use a tunnel to the mining pool.
Hetzner does allow mining anyway.

You are asking OP to put in efforts to locate TOS and actually spend more than 7 seconds to read.

Hello..I am sorry if you felt bad about asking you again about it..I apologize for it as it was rude..I did read the TOS and I couldn't find anything about mining..thank you for the help.
In that case i'd be more worried about being allowed to run sshd but that's just me.
Edit: Being a bit more serious there is a single provider that tries to disallow mining on it's dedicated servers and as pointed out it's impossible to effectively enforce such a clause anyways.

They could do scan all connections permanently, if something related to mining is detected, server suspended. OVH could that easy I guess, with there DPI for AntiDDOS.
You do not even need DPI, just the destination address, since the package is encrypted anyway, DPI wont help that much.
But still, no one will do that in reality, its just a sign that says "mining is banned".
A tunnel or VPN can easy bypass this.
Hetzner 100% cpu is allowed. I have several servers running with them, cpu is always running at 100%. No complain at all. However, I don't mine coin.
Hetzner does allow mining.
The only problem is that the rewards from mining will not cover the costs of your server.
The act of mining itself is very important.
