How much Speed should I expect on 1Gbit advertised VPS?

I bought a VPS from BudgetNode, on BF, I ran into some issue with it.
So I wanna discuss with you, about that point, maybe you have a different opinion.
When I buy a 1Gbit advertised VPS, I expect to reach 250-500Mbit peak.
I do not expect to reach 500-800Mbit.
Unfortunately, I needed UDP instead of TCP, things turned out to be worse.
TCP gets around 600-700Mbit which is fine, UDP gets around 100Mbit.
I did contact BudgetNode about that.
They refused to do anything on it, on the first answer.
On the second reply, they wanted to talk to there upstream but seems like when you buy one of these VPS's, you do not even have 10Mbit guranteed.
"But again we do not promise any minimum speeds."
Now, I am stuck with a VPS, which will not get refunded from Budgetnode, and its unlikely that they do anything on it.
Whats your opinion on that? do you think that I should expect less?

It could be a rate limit applied by the DC for DDOS reasons.

A budget provider running even lower than usual pricing. Shared 1Gbit I wouldn't expect a lot.
You were never guaranteed any speeds, just it was sold as 1Gbit shared.

Does seem a little slow, however BudgetNode is actually more expensive than many other providers here who don't share the same issues. It would be courteous (and somewhat expected) for this to be refunded, but knowing @Ishaq you'll not be able to pull a penny back out of him. Go and get PayPal to sort it out if he's not willing to fix or refund.

I could switch the VPN to TCP, but that does not really help, since its needs to tunnel UDP packages, which increase the speed just by around 50%, still slower as TCP.
I would need around 500Mbit peak in UDP, to make things work out smooth, just peak, not permanent. A few minutes.
I would expect more then 100Mbit, currently I just got around 100Mbit, so I could save money and buy a 100Mbit VPS.
Well, I reached 600-700Mbit with TCP peak, so its clearly some speed limit in place I guess.
It depends on the network between the two endpoints. I'm generally impressed if I get 200 mbit from a small VPS for any amount of time.

TCP still maxes out, its clearly not a bandwidth issue, its related to the protocol.
No, since when I enable to tunnel UDP over TPC, I get better speeds, so it can't be that.
