Pirate Bay proxy loses domain name to anti-piracy boss via a trademark (and WIPO dispute)
https://torrentfreak.com/pirate-bay-proxy-loses-domain-name-to-anti-piracy-boss-121207/
Tim Kuik, head of the Hollywood-backed anti-piracy outfit BREIN, has won a WIPO domain name dispute against a Pirate Bay proxy service. The domain timkuik.org was operating its proxy from the address fuck.timkuik.org which according to the decision infringed on a trademark held by the anti-piracy boss. The operator of the Pirate Bay proxy argued that BREIN stalked him and that the site was meant to critique the group, but WIPO says this doesn’t trump the trademark infringement.

It's sad that you have to trademark your name these days. Nothing's sacred.
Though if they wanted to create fuck-timkuik.org they'd be able to keep that, it's the name without subdomain that would lose a trademark dispute (kinda like how paypal-sucks.com etc still exists, but using paypal.info for example with a derogatory subdomain wouldn't last).
It redirects to paypal.com official site.
I don't really see a problem with this. TPB were infringing on his trademark and through an independent process he was able to claim the domain. All major corporations do this - there is minimal uproar over that. This is just piracy apologists grasping at straws to turn public opinion against these media IP groups.
the complaint site is paypalsucks.com not paypal-sucks.com
Here's the C&D PayPal sent them in 2002 http://www.chillingeffects.org/domain/notice.cgi?NoticeID=309

lol domain for sale :P timkuik.org
The site was hosted with Leaseweb before WIPO.
Stupid lousy retarded lawyers and lobbyists. We ought to outlaw the profession of practicing law. It's bribery through fancy distorted language, slick contract mumbo jumbo and outright bribes. Yes, piracy is a problem, but these groups aren't doing much to educate and change the perception about intellectual property.
"In January 2011, Dutch anti-piracy outfit BREIN targeted one of the Internet’s largest warez piracy topsites. The site, known as Swan, was taken down by hosting provider WorldStream and without judicial process BREIN seized its servers. The owners of the servers retaliated by seizing them back and may sue BREIN for breach of privacy and property rights as BREIN is a private organization and has no special legal or investigative authority."
As we see, Tim Kuik or Tim the kook, doesn't mind breaking the law stealing servers and seizing equipment without any legal power to do so.
Instead of re-seizing the Swan servers, the owners should have given Kuik a royal ass kicking.
This is the problem with our electronic economy. Some moron can just ruin your server, hand it off to someone, shutter it, block it, DDoS, etc.
Worse yet, most of the products and stores of wealth are nothing more than data that can be made to disappear with single keystrokes.
This is all in stark contrast to physically having to seize real assets which require judicial action and rights to defend your property.
Welcome to being human, nothing is fair here.
I was thinking, how hard would it be to kill one of these guys and get away with it?
Just snipe them out with a tiny .22 rifle from a two-three blocks away
Hollywood earn trillions dollar each month but they don't want to lose penny
You must align your morals with the law then, regardless of what the law says. Appeal to law.
Appeal to common practice
Borderline appeal to popularity. Leaving out other variables in the situation and focusing entirely on the common variable between the two situations as a bonus fallacy.
Borderline guilt by association. Probably some others too.
Congratulations, that must be the top amount of fallacies I've ever seen anyone on LET compress into one single post.
Maybe you should have a look into what BREIN actually does and how they do it, before claiming their reputation needs tarnishing.
AKA bad trolling.
Right then, i am trademarking my name. So that i can sue people some day :P
I'm not basing the morality of reclaiming IP on any laws or legislation. Based on my independent justifications for the ability of people to protect their IP, I had no problem with an orderly process to occur. I never implied that it was moral just because their is a process. Straw man.
I don't get why you broke these up. There is definitely an ad populum in the whole sentence. But if you are going to do this word by word analysis then the first part is a fact, not implying anything else.
Whaaaat? I'm saying this whole thing is a non-issue. It wouldn't matter if it wasn't posted by a pro-piracy propaganda website, I'm not dismissing it because of who posted/supports it. I'm saying it's a non-issue independent of it being blown out of proportions by pro-piracy teenagers.
That's clearly another straw man.
Sorry. Who are you?
Joe if you have anything constructive to say go ahead, otherwise don't waste my time.
Oh I'm sorry, haven't we been officially introduced yet? My nickname is heiska and I live on the LowEndTalk forums.
Who the fuck are you?
