I have a server right now but it appears they may be going deadpool (prefer not to mention who as I am waiting to see what is going to occur first)...can anyone suggest a replacement?
Prefer as much dedicated resources as possible, particularly CPU and HD. A little extra RAM doesn't hurt. Unmetered connection is necessary, and can go with 100Mbps or greater.
Max price I can pay is about $40/month.

There are copyright law in Germany.
Ecatel in the Netherlands has some pretty good US peering and a decent network in EU. They are however above your budget, but they won't kick you out it seems.
Plenty of Russian VPS companies don't care either and sell 100mbps unmetered vps for sometimes $40-$50/mo, I doubt they will be happy with torrenting though.

I'm not 100% positive here, but Online.net/OVH are pretty DMCA ingorent and don't "notice" torrenting. At least from my experience that is, not sure if anyone can confirm or not.
You know that OVH is located in France? The DMCA is a US copyright law. France is not part of the US (The other way around was party true, however, between 1530-1770). US laws are only valid within their territory. Why should OVH care about a DMCA?
Well yes I know that, but i'm not up on my copyright laws and I wasn't 100% sure if DMCA orders can be used on hosts in different countries. Also, does France have something similar to a DMCA..?
They do, as they are member of the WTO and a Member State in the EU. The EU has a copyright directive. The difference is, however, that within the EU you need a valid court order first. Just a §512 takedown notice (which can be a simple letter by a private person) --like in the US-- has no effect within the EU.
Every country with the bandwidth capacity to support your requirements affordably has something similar to DMCA.
You aren't really going to be 'safe' anywhere.

Actually, thanks, I checked your links on Vietnam and they have cheap unmetered but it's only 100 MB for Vietnam, it's 10 MB for outside Vietnam, so that wouldn't work. It's not dedi though.
There's gotta be some countries out there that are like them though...I know Netherlands and France, and other European countries usually cares less about DMCA...

Well, no, this is too generalized - Iran has a LOT of BW (ITC currently i.e. has 12x10G with TI Sparkle and a lot of capacity on others as well as an entire darkfiber strand to Russia which could in theory do 40(+)x100GE) and ignores pretty much anything.
Same goes for Russia (which, granted, does have laws which are ignored by anyone unless it affects Russia - Russian police stops investigating if RU Ips are blocked and they can't access it...)
and... China. China will not honor DMCA, EUCD or anything - Sure, you get the risk of local orders (which, in a dictatoric state, are pretty much to be followed in any case) but unless your content is targeted to Chinese i doubt this causes any issues.
There are others also, but then this comes to play:
Antigua - no copyright laws at all, like Iran
Vietnam - only Vietnamese can copyright in Vietnam,also applies to foreign companies in Vietnam, so limited
Pakistan - technically HAS copyright laws, but in the end as with most other laws they are not really enforced unless it affects Pakistan
Afghanistan - heh, good luck, but you CAN get hosting there.
Iraq - I'm not sure about the current situation, but the independent Kurdistan province (which is also the technological most advanced) has no coded copyright laws.
Sudan/(parts of) Nigeria/Saudi-Arabia/Mauritania/Maldives/Qatar/Yemen/(parts of) Indonesia (Aceh)/UAE outside of Dubai emirate use Sharia, i am not sure how far Sharia(Islamic law believes in copyright but from what i could find out (my hebrew is not really well, english sources are hard to come by and i can't read Arabic...) it seems to be pretty easy if the content is sort-of islamic (i.e. not porn, movies/warez are probably ok).
