The literal definition of offshore hosting that we recognize is the process of your hosting your data in a different country other than your own
However, there are more characteristics to offshore hosting:
    1-value data privacy
2-flexible content policy that doesn't violate the laws of a democratic

Cut the crap! "bulletproof hosting" is widely understood to at the very minimum ignore DMCA.
    Read your own AUP.

Seems like they do allow TOR exitnodes but they won't allow spamming from their servers. Seems fair.

If accepting TOR also means accepting spam is a different discussion however.

Still, any host that advertises hosting in The Netherlands as 'offshore' won't earn my trust. That was a long time ago.

Traffic is rejected on port 25, 587 and even 3389 and 22. So Spam is impossible to have happened.
The action someone performed over the exit node that led to suspension and further investigation was a Port Scan.
Additional to that it is normal to have a TOR exit node listed in the CBL. They even have their own article about that: https://www.abuseat.org/TOR.html

That's why NL can't be offshore. Warez and spam are prohibited and subject to strict laws. DMCA is not enforced (being that we're not in the USA) but offering copyrighted material is forbidden as well.

You might be flexible as a provider, but offering NL as an offshore location is just not going to do it. For offshore I'm thinking of locations like Moldova, Ukraine, Belarus. Where really no one cares.
