    What did however profoundly impress me was that he taped out the brand and model of his cheap chop suey toy-scope.

    (Yes, you guessed me right: Rohde & Schwarz oscilloscopes rule! hp/[insert hp brand name of the week] and tektronix are ok for low end and hobby purposes and the only real alternative to R&S is Yokogawa). If you can't afford that siglent seems to be a reasonable low cost alternative.

    In California noncompete causes are void by default and consider nonenforceable. I don't know the background but if this was a partnership, they could agree not to compete with each other but it can't be one sided.

    I am not attorney but this company sure should get one.

    Fired is one thing, having servers seized is another. If you dont like his business, increase colo price, stop renting him servers, but dont seize the ones he owns and put the condition of release to surrender his domain and customers. That is beyond sharkism, is mobism.

    Again, we're not talking about personal ideals. If he was "given" space, they could take it away at any time. If there were contracts in place, he has a hell of a lawsuit ahead of him.

    I do not dispute that, I only say they had no right to seize his assets. It looks like they wanted to make sure he can never recover from this sudden blow and only wanted to lure his customers which they did.
    If he can restore at least part of the services fast enough (which looks not that impossible once he recovers his servers), the customers would have probably not left, or not that many and certainly not go to the "shark" which caused all this in the first place.

    I also say we dont know all the story, but as much as I know in people, this seems more likely than other scenarios.

    It is possible that he told them that the servers were for something else and not running a competing business.

    Many many years ago a buddy of mine worked for a telecom backbone provider. We use to have servers in there all the time that nobody was aware of. When the company was bought out the company in 2000 we just moved the hardware out.

    Yep, I was right, they hold his HW hostage.
    It also looks like a plausible story from their point of view, I would be pissed also if an employee uses his paid time to run his own business using my resources, etc.
    But this does not give me the right to confiscate his car in the parking pending legal action.

    They state reseller account, so it might not be his hardware at all.

    It depends what IP means, could be Intelectual Property or IPv4/6, in the first case they could file a lawsuit, in the second do what they did already, pull the plug.
    Still no right to confiscate the gear.

    If he's not paying for the colocation, or it's being used to prove that he worked for himself while they were paying for him- they should have waited for an injunction, but they were eventually going to have the right. If they left the hardware where it was- but disconnected the ethernet- they will likely be found to be not held liable.
