Is the original owner still liable in that situation?

Yes he will still be liable so thats why I made it clear that I am willing to let these go only if I can transfer them to your own account.

I cant give my account because its under my name and because I have other servers active in production.

I have asked them, no transfer are allowed.

Only full account transfers are allowed. Servers cannot be transferred.
