When people order, are every one of them aware of the fact that there is 50-150 (that range tho) or whatever the amount is on the server? No. They are not. Nor do anyone except the host itself. So if you don't have the data, You can't make that call.
Further, what is to stop the host from keep on selling? Let's assume we do have the data.
5% seem excessive? But why stop there? Maybe host want to squeeze in more people. using 3% would be excess tomorrow by that measurement. Then 1%. Are you a dick for using more than 1% too? What about 0.5%? Where do you draw the line?

So how do one's action qualify as viewing it as "shared resource" and "not viewing it as shared resource"? What is too much? Where is the line and would what you define as too much be consistent across multiple impartial individuals?
How can you not see the harm in being too broad?
Let me give you an example.
We all share Earth as a resource. Let's say there is a law for everyone that says "excessive use of Earths resource is grounds for being jailed indefinitely/death sentence". What is considered excessive will be solely determined by this random police agency whose interest may not be align with you. There is no tolerance and you will get the death sentence or be jailed indefinitely on the first offense. It will not be consistent across the broad on how it's applied as it's based on discretion. You will be ok with this I presume?
Or let's say there is a law that says anyone that stays in a library too long will be kicked out since its a shared resource. There is no stated duration and it will be up to the Liberian discretion based solely on their mood that day and hour. Some get kick out after 1 hour, other can stay all day without problem. Oh and if you get kicked out once, your banned.
"No food or drinks near computer station station" is fine because the expectation is clear and well understood by everyone.
"No staying on the computer too long" is fked up and stupid because what is "too long" would be different if you ask 10 different people. The expectation is not understood by everyone as it differs.
This discretion on something so vague that it technically includes everyone and could be used to punish anyone with no tolerance and warning on a non consistent basis is a insult to the term "justice" and best describe a dictatorship.
